2. Services Provided

Eligibility: You must be at least 18 years old to enter into agreements for services.
Service Agreements: All projects and campaigns require a written agreement detailing the scope, timeline, deliverables, and fees.
Client Responsibilities: Clients must provide accurate and timely information, assets, and approvals to ensure smooth execution of services.
3. Fees and Payment
Fees for services will be specified in a proposal or contract before commencement of work.
A deposit may be required before project initiation.
Payments must be made as per the agreed-upon schedule. Late payments may result in service delays or suspension.
Additional charges may apply for revisions beyond the agreed scope or additional work requested.
4. Intellectual Property
Any marketing materials, branding assets, and content created by The AdGency remain the property of The AdGency until full payment is received.
Upon full payment, ownership rights may be transferred to the client as outlined in the agreement.
The AdGency reserves the right to showcase completed work in its portfolio and promotional materials unless otherwise agreed upon.
5. Client Content and Responsibility
Clients must ensure that all content, images, videos, and materials provided to The AdGency do not infringe on any copyrights or third-party rights.
The AdGency is not responsible for any legal issues arising from the use of client-provided content.
6. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information exchanged during the course of business. Non-disclosure agreements (NDAs) can be signed upon request.
7. Revisions and Modifications
Clients are entitled to revisions as outlined in the service agreement.
Additional revisions beyond the agreed scope may be subject to additional charges.
8. Termination of Services
Either party may terminate the service agreement with written notice if the other party breaches these Terms.
If termination occurs, the client must pay for any completed work up to the termination date.
The AdGency is not obligated to provide refunds for work already performed.
9. Limitation of Liability
To the fullest extent permitted by law, The AdGency and its affiliates, employees, and partners shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities, arising from the use of our services.
10. Disclaimers
The AdGency provides its services “as is” and does not guarantee specific results from any marketing efforts.
While we strive to deliver effective campaigns and strategies, The AdGency is not responsible for the performance of external platforms (e.g., social media algorithms, search engine rankings, or third-party ad performance).
11. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the United States of America. Any legal disputes will be resolved in a competent court of jurisdiction.
